Conflict Minerals Policy

Onto Innovation is committed to sourcing conflict-free materials and we have asked our suppliers to join us in this commitment. As a part of our commitment we have voluntarily adopted the Responsible Business Alliance (RBA) Code of Conduct. Onto Innovation also requires our next tier suppliers to acknowledge and implement the RBA Code.

This Conflict Minerals Report of Onto Innovation Inc. has been prepared pursuant to Rule 13p-1 and Form SD (the “Rule”) promulgated under the Securities Exchange Act of 1934 for the reporting period December 31, 2023, to December 28, 2024. The Rule requires disclosure of certain information when a company manufactures or contracts to manufacture products and certain minerals specified in the Rule are necessary to the functionality or production of those products.

REACH and RoHS Declaration
Registration, Evaluation, Authorization, and Restriction of Chemicals Regulation (EC) No 1907/2006

The Registration, Evaluation, Authorization, and Restriction of Chemicals (REACH) regulation is a chemical regulatory framework applicable in the 27 European Union member states, as well as the European Free Trade Association (EFTA) and European Economic Area (EEA) countries. The REACH regulation came into force on June 1, 2007. The regulation will be phased in over an eleven-year period, ending in 2018. The regulation is aimed at gathering information on chemical use and to improve public health and safety within the European Economic Area. Substances of Very High Concern (SVHC) are identified on the REACH candidate list, which was last updated December 2016.

Onto Innovation is committed to working with our supply chain to fully comply with REACH, and to provide our customers with the appropriate information regarding SVHC within Onto Innovation products.

Onto Innovation REACH Declaration

Based on the knowledge of Onto Innovation, products and product packaging sold into or delivered into The European Economic Area (EEA) do not contain Substances of Very High Concern (SVHC) from the REACH Candidate List in a concentration above 0.1 percent weight by weight (w/w). Some cables and cable assemblies with the product may contain the following substances from the candidate list, well below a concentration of 0.1 percent weight by weight (w/w).

Benzyl butyl phthalate (BBP) (CAS No 85-68-7, EC No 201-622-7)

Dibutyl phthalate (DBP) (CAS No 84-74-2, EC No 201-557-4)

Bis(2-ethylhexyl) phthalate (DEHP) (CAS No 117-81-7, EC No 204-211-0)

Diisobutyl phthalate (DIBP) (CAS No 84-69-5, EC No 201-553-2)

This declaration will be updated to reflect any future changes made to the Candidate List or the overall REACH regulation.

Onto Innovation RoHS Declaration

The Restriction of Hazardous Substances or RoHS, also known as Directive 2002/95/EC, originated in the European Union and restricts the use of specific hazardous materials found in electrical and electronic products effective July 1, 2006. Substances banned under RoHS are lead (Pb), mercury (Hg), cadmium (Cd), hexavalent chromium (CrVI), polybrominated biphenyls (PBB), polybrominated diphenyl ethers (PBDE), and four different phthalates (DEHP, BBP, DBP, DIBP).

While Onto Innovation complies with RoHS on a best effort basis, our products are currently exempted from RoHS compliance per the Large Stationary Industrial Tools (LSIT) exception.

Onto Innovation provides this information to its customers upon request.
